What Is a Family Law Consent Order?

Essentially, consent orders are legally binding agreements between you and your ex-spouse regarding parenting and/or property settlement matters.

A consent order is an efficient way to make a legally binding agreement with your ex-spouse if you have been able to come to an agreement regarding the arrangements of your children and property, outside of court.

Consent orders do not involve court hearings, saving both parties time and costs.

Consent orders are made by both parties drafting their orders then applying to get the court to approve them. Once approved by the court, the orders are made enforceable and each party must follow these orders.

They have the same effect as any other court order whereby if the consent order is breached, this is enforceable by the court.
